Reading this form in no way obligates you to purchase our services or products. We simply want to know that you understand and know our Terms Of Service Guidelines we work by. Your payment for services and/or hosting to Red Seven Creative is considered acceptance of our Terms of Use, whether you have read them or not. This agreement becomes effective after any payment is received, be it a deposit or full payment.

Acceptance Of Terms:
Red Seven Creative provides its services to you subject to the following Terms of Service, which may be updated on this site from time to time without notice. You can review the most current version of the Terms Of Service at any time by returning to this web page. When using Red Seven Creative services, you shall be subject to any posted guidelines or rules applicable to such services which will be posted on this Terms Of Service page. Our Terms Of Service is subject to change. Please review our Terms Of Service from time to time as changes may occur.

Description Of Red Seven Creative Services:
We offer website design services to anyone wishing to make their presence known whether it be for business or personal use on the world wide web. We construct and design per customer order and specifications. We specialize in Home Business, Small Business as well as Personal Web Design.

The Design Process:
After you supply us with the necessary copy, graphics, images etc. and pay the required deposit, we will begin the design process. At such as time that we have produced a layout for your website that is available for you to view, you will be able to preview your website using a URL we provide. During this time you will be able to request additions and or changes to the design.

Design Restrictions:
We do not produce graphic design work, build, construct or design websites that participate in illegal or adult activities which includes but not limited to pornography, offensive materials, illegal MP3 download websites and any and all materials of an adult nature.

Host Server Down Time:
Red Seven Creative is not responsible for any hosting server service problems that may arise including but not limited to electric services outages, cell service outages, phone service outages & cable service outages. For above mentioned service problems contact your service provider.

CLIENT RESPONSIBILITY

ORDERING WEB DESIGN:
When ordering web design it is your responsibility to provide Red Seven Creative with all text, images, graphics and other items such as special animation and logos you wish to have posted to your website. If you do not have the items mentioned above and wish Red Seven Creative to create them for you there will be extra charges incurred by you for their creation.

INFORMATION YOU PROVIDE:
You are responsible and liable for the information you provide to Red Seven Creative for placement on your website. Make sure you do not use copyright materials of any kind unless you own the copyright. If you are using materials belonging to a third party, you are responsible for obtaining permission from the copyright holder, and it will be assumed that you have done so if you give Red Seven Creative any materials for use on your website. You therefore assume all responsibility for any legal issues that may arise as a result of the use of copyright materials on your website at your request.

WEB HOSTING:
You are responsible for providing your own web hosting account and domain name. You will need to supply Red Seven Creative with your Control Panel or FTP login information so we may set up your server and or upload your website to your hosting server.

If you wish for Red Seven Creative to provide hosting for you, we will require a written signature authorising us to do so on your behalf for the fees specified at that time. We will require payment up front of each billing cycle in order for us to continue to find hosting your website. Failure to pay before the specified date will constitute a termination of your contract with us and may cause your website to immediately cease to be displayed online.

DOMAIN NAME:
If you already own a Dot Com Name, you will be required to provide us with the web address of where you purchased your Dot Com Name. If your Dot Com Name is not hosted on the same server as your website, you will be required to provide us with the necessary login information in order to point your domain name to your website. If you do not own a Dot Com Name but would like to purchase one, please let us know what name you would like so we can check its availability status. Domain registrations are billed annually and you are responsible for renewal costs. Refunds will not be given under any circumstances for domain registration or renewal.

RESALE or GIVE AWAY RIGHTS:
You do not have resale rights or give away rights to creations made or supplied by Red Seven Creative for your web site including layouts, designs, graphics, images, PHP, flash animations or logos. You may use creations made or supplied by Red Seven Creative for your web site only. Resale rights (or exclusive rights) for items supplied by Red Seven Creative may be purchased for additional fees. BUSINESS COURTESY LINK:
You agree to the placement of a small link on your web site that will direct your website visitors to RedSevenCreative.com. The link will be placed at the very bottom of each page in your design. The link will say "Website Design by Red Seven Creative".

PAYMENT FOR WEB DESIGN SERVICES:
All pricing is guaranteed for the term of pre-payment. Red Seven Creative reserves the right to change prices at any time.

A deposit is required from any new client before any work is carried out. It is the Red Seven Creative policy that any outstanding accounts for work carried out by Red Seven Creative or its affiliates are required to be paid in full, no later than 30 days from the date of the invoice unless by prior arrangement with Red Seven Creative. Failure to pay within 30 days of the invoice date will result in your website being turned off until payment is made. A $20 fee will be charged to the client for reactivating their website. Payment is due each anniversary day or period following the date the account was established. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Red Seven Creative in writing for a request for termination of services. We will contact clients via email and telephone to remind them of such payments if they are not received when due.

Once the client's website or graphic design work has been designed and completed with your acceptance, the final balance of payment is then due in accordance with our payment terms upon receipt of your billing invoice from Red Seven Creative. There are no exceptions to this, i.e. if the client decides they no longer want the site, and they have commissioned the work and paid a deposit, they are still obliged to pay for the work that has been done. Non-payment may result in legal action being taken if necessary. Once full payment is received for a website, your site will be transferred to your web hosting server ready for public viewing. At this point, it is assumed that the project has been completed to the client's satisfaction and no refunds can be offered. We do offer free updates for a month after completion to allow for any final amendments that may be required.

CANCELLATION:
Red Seven Creative reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Red Seven Creative if Red Seven Creative institutes its right of cancellation. If cancellation is caused by customer's violation of these policies, then no refund is due.
Setup fees and deposits that have been paid in order for Red Seven Creative to begin work for the customer are nonrefundable. Customers can cancel service any time and be refunded any due amount exceeding the pre-payment of the current billing month. The service will be cancelled at the end of the current billing period, unless a date of cancellation is specified.

ADVERTISING:
You agree to allow Red Seven Creative to use images of your web site in all advertising campaigns. Site images are used for example and advertising. Red Seven Creative retains all rights as well as advertising rights to all web designs, web sites and creations indefinitely.

WEBSITE OPTIMIZATION:
Due to external factors, such as changes to the way search engines rank websites, we cannot offer any guarantees regarding the position we will achieve for websites. The process of optimizing websites itself will bring in more traffic and hits and you’ll see visits increase to your site naturally. We cannot accept liablility for any change in rankings, or drop off in the position of your website due to changes in the algorithms of the search engines or the factors that they use to rank websites.

LAWFUL PURPOSES:
Red Seven Creative reserves the right to refuse service to anyone. Customers may only use Red Seven Creative for lawful purposes. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Red Seven Creative expressly forbids anyone from using Red Seven Creative's servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, offensive materials, and any and all materials of an adult nature.

INDEMNITY:
Customer agrees that it shall defend, indemnify, save and hold Red Seven Creative harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Red Seven Creative, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Red Seven Creative against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Red Seven Creative's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Red Seven Creative's server.

Any violation of Red Seven Creative TOS (terms of service) and copyright law violations will result in termination of your web design package.

DISCLAIMER:
Red Seven Creative will not be responsible for any damages your business may suffer. Red Seven Creative makes no warranties of any kind, expressed or implied for services we provide. Red Seven Creative disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Red Seven Creative and its employees. Red Seven Creative reserves the right to revise its policies at any time.
Use of Red Seven Creative Services constitutes full, informed consent to these terms of service.
